Terms and Conditions of Service

These terms and conditions govern your use of our website and the purchase of any product or service from us. By accessing our website, you agree to be bound by these terms and conditions and we recommend that you read them carefully before making any purchase. Using the Service

The customer undertakes to use this service in compliance with the laws and regulations in force applicable to it, as well as the Terms and Conditions set out herein.

Max Titanium – Erne Trade Lda may, at any time, change all or part of these Terms and Conditions.

The customer may not alter the content of the Service or send messages that contain computer viruses or may cause any other damage.

Customers of the online store are considered final consumers, subject to VAT, with the exception of those residing in third countries outside the European Union. Reseller customers will also have different access to the website, where prices will be shown excluding VAT.

The sale process is subject to compliance with the rules defined by Law no. 25/2008 of June 5, on the prevention and repression of the laundering of ill-gotten gains and the financing of terrorism.

Products in the Online Shop

Products duly identified in the respective catalogs can be purchased in the online store.

The fact that a product is not available in the online store does not mean that it is out of stock at Max Titanium, as it may be available through another of the company’s distribution channels.

Prices

The prices shown in the catalog include VAT at the legal rate in force at the time of purchase, plus shipping costs.

The price of the products, the amount of VAT and the cost of shipping are all duly itemized before the final validation phase of the purchase.

Any other costs resulting from sending orders abroad, including customs clearance costs, will be the sole responsibility of the purchaser of the product.

Max Titanium (Erne Trade Lda) informs that the prices practiced at https://www.maxtitanium.eu are exclusive to the company’s Online Shop and may vary from the prices in physical stores.

Order

The order for a product chosen from the product catalog is placed in the shopping cart;

For some products, duly identified in the online store, the purchase may be limited to a certain number of copies.

The customer can cancel the order by emailing us: info@maxtitanium.eu for purchases made before 2 p.m. that day; for purchases made after 2 p.m., cancellation can be made until 5 p.m. the following day.

The cancellation request will only take effect when the order number and the customer’s name are indicated.

If the customer returns the items ordered in compliance with the legal rules applicable to distance and off-premises contracts, Max Titanium (Erne Trade Lda) will refund the purchase money.

Max Titanium (Erne Trade Lda) will bear the cost of return postage if the item is damaged or if there has been an error in its dispatch.

Payment methods

Products can be paid for using the various electronic payment methods available.

The payment system options for purchases are Multibanco, MB Way, Credit Cards such as VISA, Mastercard, among others, Paypal and bank transfer. Max Titanium (Erne Trade Lda) reserves the ordered product for 24 hours, after which time, if payment is not confirmed, the order may be canceled.

Delivery time

In mainland Portugal, orders are usually delivered within 1 to 2 working days of the date of payment.

In the Autonomous Regions and depending on the islands, the delivery time can vary between 5 and 10 working days.

Deliveries to Europe and the rest of the world vary according to destination and transportation time. Please note that we do not currently deliver outside the European Union.

Order deliveries may, in occasional cases, be delayed due to stock shortages.

Product returns

The delivery of products purchased in this service complies with the legal rules applicable in Portugal to the exercise of distance commerce (Decree-Law no. 24/14, 14.02 – CONTRACTS CELEBRATED AT A DISTANCE AND OUTSIDE THE COMMERCIAL ESTABLISHMENT).

The Customer/user has the right to complain about any defect, inaccuracy or inadequacy of the product in relation to what was ordered, within the legal time limits established for this purpose.

Online Shop Registration

Individual registration in the online store is done under “Registration”.

This registration makes the purchasing process easier by recording the customer’s identification data, allowing them to be recognized immediately without having to type it in again.

Customers can update their personal details online whenever they make a purchase in the online store.

Access is restricted to each user and guaranteed by the use of a login and password.

Privacy and Security Policy

Max Titanium (Erne Trade Lda) collects the customer’s personal data for the purposes of managing the customer’s account, invoicing, providing information, as expressly authorized for this purpose, assuming a commitment to privacy and security in the processing and maintenance of each customer’s personal data, under the terms of Law 67/98 of October 26, may use “cookies” – which are a small data file that a server sends to your browser when you access a web page – in order to help us determine the usefulness, interest and number of uses of Max Titanium (Erne Trade Lda).

The entire payment process, from selecting the payment method to entering the data inherent in the order payment process, is duly protected with appropriate electronic security tools.

Applicable Law and Jurisdiction

Portuguese law applies to this agreement.

For the resolution of disputes arising from this contract, the courts of the District of Oporto shall have jurisdiction, expressly waiving any other jurisdiction.
